The short version
- We collect the information you give us (like your name, email and website content), information collected automatically (like device data and cookies), and limited information from partners such as Google Sign-In and payment processors.
- We use it to run, secure, support and improve eProfitify, to bill you, and, if you allow it, to send you updates and offers.
- We do not sell your personal information for money. We share it with service providers who help us run eProfitify, and where the law requires.
- If you build a website on eProfitify, you are responsible for the personal information of your own visitors and customers. We process it for you, on your instructions.
- We use reasonable security measures, but no system is completely secure.
This summary is for convenience only. The full policy below is what applies.
1. Who we are and what this covers
eProfitify is operated by eProfitfy ("eProfitify", "we", "us" or "our"). This Privacy Policy applies to personal information we collect through eprofitify.com and its sub-domains, our apps, the Paraclete editor, the Communication Hub, eShop, eDocuflow, eRealty, AdOrbit, Print, our support channels and related services (together, the "Service").
This policy does not cover the websites our customers build and run on eProfitify, or how our customers use the information of their own visitors and customers. Those websites are controlled by our customers and are covered by their own privacy notices (see Section 6). It also does not cover third-party websites and services, even if they are linked from or connected to the Service.
By using the Service, you acknowledge that you have read this policy. Words such as "Account", "Your Content", "Your Site", "End Users" and "Third-Party Services" have the meanings given in our Terms of Service.
2. Information we collect
Information you give us
- Account and profile information: name, email address, phone number, username, password, business name and address, and profile details.
- Billing information: plan, billing name and address, and transaction details. Card and PayPal payments are handled by our payment processors under their own security standards; we receive limited payment information from them (for example, payment status and the last digits or type of card) rather than storing full card numbers ourselves.
- Your Content: the text, images, videos, products, listings, documents, agreements, forms, chat messages and other content you create, upload or send through the Service.
- Staff accounts: details of employees or team members you add, such as names, specialties, photos, descriptions and login details.
- Communications: messages you send us through Live Tech chat, email, forms, surveys or social media, and call or meeting notes from onboarding and support.
Information collected automatically
- Log and device data: IP address, browser type and version, device type, operating system, language, referring pages, pages viewed, dates and times, and error data.
- Usage data: how you use the Service, such as features used, settings, clicks and session information.
- Approximate location: derived from your IP address.
- Cookies and similar technologies: see Section 7.
Information from third parties
- Sign-in providers: if you sign in with Google, we receive basic profile information such as your name, email address and profile picture (see Section 8).
- Payment processors: payment status, transaction identifiers and related details.
- Referral partners: if you arrive through a referral link, the referral code that identifies the partner who referred you.
- Connected services: information you choose to share when you connect Third-Party Services such as WhatsApp, Facebook, Microsoft Teams, YouTube, Google Maps or Google Forms.
End User information
When visitors use a website built on eProfitify, the Service may collect information on behalf of the website owner, such as chat messages, contact form submissions, email sign-ups, survey answers, bookings, orders, delivery details, payment status and e-signature details. We process this information for our customer, as described in Section 6.
3. How we use information
We use personal information to:
- provide, operate, host, maintain and deliver the Service, including publishing Your Site;
- create and manage Accounts, authenticate users and remember your settings;
- process payments, subscriptions, renewals and domains, and send related notices;
- provide support, onboarding and training, and respond to your requests;
- send service messages, such as security alerts, account notices and changes to our terms or policies;
- send marketing and promotional messages, where permitted, with an option to opt out;
- measure, analyze and improve the Service, develop new features, and understand how it is used;
- detect, prevent and investigate fraud, abuse, security incidents, spam and breaches of our Acceptable Use Policy;
- enforce our Terms, protect our rights, property and safety and those of our users and others, and defend legal claims;
- comply with legal obligations, such as tax, accounting and law-enforcement requests; and
- for any other purpose we describe to you when we collect the information, or with your consent.
We may also create aggregated or de-identified information that does not reasonably identify you, and use and share it for any lawful purpose, such as usage statistics and product research.
4. Legal bases (EEA and UK)
Where the EU or UK General Data Protection Regulation applies, we rely on these legal bases:
- Contract: to provide the Service you signed up for and process payments.
- Legitimate interests: to secure, support, analyze and improve the Service, prevent fraud and abuse, market our services to business customers, and establish or defend legal claims, where those interests are not overridden by your rights.
- Consent: for certain cookies and marketing messages where consent is required. You can withdraw consent at any time; this does not affect processing before withdrawal.
- Legal obligation: to comply with applicable laws and lawful requests.
5. How we share information
We do not sell personal information in exchange for money. We may share personal information:
- With service providers who help us operate the Service, under agreements that limit their use of the information to providing services to us. These include hosting and data-center providers, content delivery and font providers, payment processors, analytics providers (such as Google Analytics), sign-in providers, email and messaging providers, customer support tools, and professional advisers such as accountants and lawyers.
- With Third-Party Services you choose to use or connect, such as domain registrars, payment providers, YouTube, Google Maps, Google Forms, WhatsApp and other messaging add-ons. Their use of your information is governed by their own policies.
- With other users, as you direct: for example, content you publish on Your Site is public, agreements you send through eDocuflow are shared with their recipients, and staff accounts can see information you give them access to.
- With our referral and reseller partners, limited to information needed to credit a referral.
- For legal, safety and enforcement reasons: if we believe disclosure is reasonably necessary to comply with law, regulation, legal process or a government request; to enforce our Terms; to detect or prevent fraud, abuse or security issues; or to protect the rights, property or safety of eProfitify, our users or others.
- In a business transaction: in connection with a merger, acquisition, financing, reorganization, sale of assets or bankruptcy, in which case information may be transferred to the new owner.
- With our affiliates, for purposes consistent with this policy.
- With your consent or at your direction.
6. Websites built on eProfitify
When you build Your Site on eProfitify, you are the controller (or "business") responsible for the personal information of your End Users, and eProfitify acts as your processor (or "service provider"), processing that information on your behalf and on your instructions, as needed to provide the Service.
As a website owner, you are responsible for:
- publishing your own privacy notice and, where required, cookie notice and consent tools on Your Site;
- having a lawful basis and any required consents for the information you collect through chat, forms, email collection, surveys, bookings, orders, analytics and e-signatures;
- responding to your End Users' privacy requests (we will provide reasonable assistance where required by law); and
- making sure any Third-Party Services, add-ons or apps you use on Your Site meet the laws that apply to you.
We are not responsible for the privacy or security practices of our customers. If you are a visitor or customer of a website built on eProfitify and have a question about your information, please contact that website's owner. If you contact us, we may refer your request to them.
7. Cookies and similar technologies
We and our partners use cookies, pixels, local storage and similar technologies on eprofitify.com and the Service. Cookies are small files stored on your device that help websites remember you and understand how they are used.
| Type | What it does |
|---|---|
| Essential | Required for core features such as signing in, keeping your session secure, the editor, shopping carts, checkout and load balancing. These cannot be switched off in our systems. |
| Functionality | Remembers your preferences, such as settings, language, timezone and referral codes. |
| Analytics and performance | Helps us understand how the Service is used and fix problems, for example through Google Analytics. |
| Advertising and marketing | Helps us measure our marketing and show more relevant promotions. Some of these may be set by third parties and used across other websites. |
| Third-party embeds | Content such as YouTube videos and Google Maps may set their own cookies when you view or interact with them. |
Your choices: you can block or delete cookies through your browser settings, and you can opt out of Google Analytics using Google's browser add-on. Blocking essential cookies may stop parts of the Service from working. Where the law requires consent for non-essential cookies, we will ask for it. Some browsers send "Do Not Track" signals; because there is no common standard for them, we do not respond to them, but we will honor Global Privacy Control signals where the law requires us to.
We are not responsible for cookies or technologies set by third parties, which are governed by their own policies.
8. Google Sign-In data
If you choose to sign in with Google, we receive basic profile information (your name, email address and profile picture) to create and secure your Account. We do not use this information for advertising, and we do not sell it. eProfitify's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
9. YouTube API Services
eProfitify uses YouTube API Services to publish our own marketing videos to our own YouTube channel, and, where a feature lets you connect YouTube to your eProfitify website, to display or link to YouTube content you choose. By using any eProfitify feature that uses YouTube, you agree to be bound by the YouTube Terms of Service. Google's handling of information is described in the Google Privacy Policy.
- What we access: only what a feature needs, such as permission to upload videos to a channel and the channel's basic details. We do not access your YouTube watch history, comments, subscriptions or other personal data.
- How we use and share it: only to provide the feature you asked for. We do not sell YouTube data, use it for advertising, or share it with anyone except as needed to run the Service.
- What we store: the access token for the connected channel and the IDs and links of videos uploaded through eProfitify. Tokens are kept securely and are never shared.
- Revoking access: you can remove eProfitify's access to your Google or YouTube account at any time at Google security settings → Third-party apps with account access.
- Deletion: when access is revoked, a feature is disconnected, or you ask us, we delete the stored tokens and YouTube data within 30 days (or sooner if the YouTube API Services policies require). We also refresh or delete stored YouTube data at least every 30 days. To request deletion, contact us (see Contact us).
10. International transfers
eProfitify is hosted primarily in the United States, and we and our service providers may process information in other countries. These countries may have data protection laws that differ from those where you live. Where the law requires, we use appropriate safeguards for international transfers, such as standard contractual clauses approved by the relevant authorities. By using the Service, you understand that your information may be transferred to and processed in these countries.
11. How long we keep information
We keep personal information for as long as reasonably necessary for the purposes in this policy, including to provide the Service, keep records required by law (for example tax and accounting records), resolve disputes, prevent fraud and abuse, enforce our agreements, and maintain backups. When your Account is closed, we may delete or de-identify Your Content as described in our Terms of Service. Copies may remain in backups for a limited time until they are overwritten. We are not responsible for any loss of data after an Account is closed, so please export anything you need beforehand.
12. Security
We use reasonable administrative, technical and physical measures designed to protect personal information, such as encrypted connections (SSL/TLS) and access controls. However, no method of transmission over the internet or method of storage is completely secure, and we cannot guarantee the security of any information. You use the Service at your own risk.
You are responsible for keeping your password and devices secure, for the access you give to staff accounts, and for the security of any information you choose to collect or publish on Your Site. If we become aware of a security incident that affects your personal information, we will notify you and the authorities where the law requires.
13. Your choices and rights
- Account information: you can review and update most Account information in your dashboard and profile.
- Marketing: you can opt out at any time (see Section 15).
- Cookies: see Section 7.
Depending on where you live, you may have the right to request access to, correction of, deletion of, or a copy of your personal information; to object to or restrict certain processing; to withdraw consent; and to opt out of certain uses such as targeted advertising. If you are in the EEA or UK, you also have the right to complain to your local data protection authority.
To make a request, email help@eprofitify.com with the subject "Privacy request". We will need to verify your identity before acting on a request, and we may ask for additional information to do so. An authorized agent may make a request for you if they provide proof of authorization. We will respond within the time required by applicable law. We may decline or limit a request where the law allows, for example where we must keep information to comply with legal obligations, to complete a transaction, to prevent fraud or to establish or defend legal claims, or where a request is manifestly unfounded or excessive. If we deny your request, you may appeal by replying to our decision. We will not discriminate against you for exercising your privacy rights.
Requests about information collected by a website built on eProfitify should be sent to that website's owner.
14. Additional US state disclosures
Residents of California and other US states with consumer privacy laws may have the rights described in Section 13. In the past 12 months, we have collected the categories of personal information described in Section 2: identifiers (such as name, email, IP address); customer records and commercial information (such as plans and transactions); internet and network activity; approximate geolocation; audio or electronic information (such as support chats and recordings, where applicable); professional or business information; and inferences drawn from usage. We collect them from the sources in Section 2, use them for the purposes in Section 3, and disclose them to the categories of recipients in Section 5.
We do not sell personal information for money. Our use of analytics and advertising cookies may be considered "sharing" or "targeted advertising" under some state laws. You can opt out by adjusting your cookie settings, using a Global Privacy Control signal, or contacting us. We do not knowingly sell or share the personal information of anyone under 16. We do not use sensitive personal information for purposes that would give rise to a right to limit its use.
15. Marketing messages
We may send you news, tips and offers about eProfitify where the law allows. You can opt out at any time using the "unsubscribe" link in our emails or by contacting us. Even if you opt out, we may still send you messages about your Account, security, billing and changes to our terms or policies.
16. Children
The Service is intended for adults and businesses and is not directed to children. You must be at least 18 years old (or the age of majority where you live) to create an Account. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, contact us and we will take appropriate steps to delete it. Website owners are responsible for complying with children's privacy laws on their own websites.
17. Third-party sites and services
The Service links to and integrates with websites and services we do not control, including payment processors, domain registrars, social networks, messaging apps, video and map services. This policy does not apply to them, and we are not responsible for their content, privacy or security practices. Please review their privacy policies before using them.
18. Relationship to our Terms
This Privacy Policy forms part of, and is governed by, our Terms of Service, including its sections on disclaimers, limitation of liability, governing law and disputes, which apply to any claim relating to privacy or data to the fullest extent permitted by law. Nothing in this policy creates rights for any third party or limits any rights you have under applicable data protection law that cannot be limited by contract. If a translation of this policy differs from the English version, the English version controls.
19. Changes to this policy
We may update this policy from time to time. We will change the "Last updated" date above and, for material changes, give reasonable notice, for example by email or a notice in your dashboard, before the changes take effect where required by law. If you keep using the Service after changes take effect, the updated policy will apply.
